Terms of Service

1. Acceptance of Terms

By creating an account or otherwise accessing GroupHabits ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to use the Service (or such higher age as required in your jurisdiction — 16 in some EU member states). By creating an account you represent that you meet this requirement. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these terms on your behalf.

3. Description of Service

GroupHabits is a habit-tracking application that lets users create and join accountability groups, track personal and shared habits, and monitor progress over time. The Service includes web-based access and progressive web app (PWA) installation.

4. User Accounts

To use core features you must create an account. You agree to:

  • Provide accurate, complete, and current registration information
  • Maintain the confidentiality of your password
  • Accept responsibility for all activity that occurs under your account
  • Notify us immediately of any unauthorised use of your account at grouphabitmvp@gmail.com

5. Subscriptions and Payments

GroupHabits offers free and paid subscription tiers. For paid subscriptions:

  • Payment is processed securely by Stripe. You agree to Stripe's terms in addition to ours.
  • Subscriptions renew automatically at the end of each billing period unless cancelled.
  • You may cancel at any time; paid access continues until the end of the current billing period.
  • Refunds for unused periods are provided at our discretion. To request a refund, contact us within 14 days of the charge.
  • We will provide at least 30 days' notice of any price increase, by email and/or in-app notification.

6. Free Trial

New group subscriptions include a 14-day free trial. You will not be charged during the trial. If you do not cancel before the trial ends, your subscription converts to a paid plan automatically. All group data created during the trial is retained when a paid subscription begins.

7. Group Membership and Owner Access to Member Data

GroupHabits is an accountability platform. A central feature of the Service is that group owners can monitor the performance of their group members to provide support and accountability. By joining a group you explicitly acknowledge and agree that:

  • The group owner can view your completion rate, current streak, longest streak, total completed days, and last-active date for shared habits within that group.
  • The group owner can see whether you are flagged as "at risk" based on recent inactivity relative to your personal baseline within the group.
  • The group owner can export the above statistics for all members of the group as a CSV file at any time.
  • GroupHabits makes this data available to group owners as part of the paid subscription features.

Group owners cannot access your private habits, journal entries, private reflections, or any activity outside the shared habits of the group.

When a group owner exports member data, they take on responsibility as an independent data controller for that exported file. GroupHabits is not responsible for the subsequent handling of exported data by group owners. Group owners must handle exported member data in accordance with applicable data protection law.

You may leave a group at any time from your group settings. On leaving, you are removed from future owner reports. Historical data already exported by the group owner before your departure is outside our control.

8. Group Owner Responsibilities

As a group owner you agree to:

  • Use member analytics and exported data only for the purpose of supporting and managing your group.
  • Not share, sell, or otherwise distribute member data to third parties outside the group context.
  • Store any exported member data securely and delete it when no longer needed.
  • Comply with applicable data protection law (including UK GDPR / EU GDPR if you or your members are in those jurisdictions) when handling exported member data.
  • Ensure your group members are aware that you have access to the performance statistics described in Section 7.
  • Manage your group responsibly, ensuring members comply with these Terms.

GroupHabits reserves the right to suspend or remove a group owner's access to analytics features if we have reasonable grounds to believe member data is being misused.

9. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Harass, abuse, bully, or harm other users
  • Upload malicious code or attempt to compromise the security of the Service
  • Impersonate any person or entity or misrepresent your affiliation
  • Scrape, crawl, or otherwise extract data from the Service in an automated manner without our written consent
  • Use the Service for any illegal, fraudulent, or unauthorised purpose
  • Interfere with or disrupt the Service, its servers, or its infrastructure

10. User Content

You retain ownership of content you create (habit names, journal entries, check-ins, etc.). By using the Service you grant us a non-exclusive, worldwide, royalty-free licence to store, process, and display your content solely as necessary to provide the Service to you and your group members.

You are responsible for the content you create. We reserve the right to remove content that violates these Terms without notice. We will not access or read your private journal entries or private reflections except where strictly necessary for legal compliance, security investigation, or at your specific request.

11. Intellectual Property

The Service — including its design, code, branding, and non-user-generated content — is owned by GroupHabits and protected by copyright and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works from any part of the Service without our prior written permission.

12. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free
  • Any results obtained from using the Service will be accurate or reliable
  • The Service will meet your specific requirements

13. Limitation of Liability

To the maximum extent permitted by applicable law, GroupHabits shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of (or inability to use) the Service. Our total aggregate liability to you for any claim arising under these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim, or £50, whichever is greater. Nothing in these Terms excludes liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

14. Termination

You may delete your account at any time from your profile settings. Deletion is permanent and immediate — all your data is removed as described in our Privacy Policy.

We may suspend or terminate your access to the Service immediately, without prior notice, if you breach these Terms, if we are required to by law, or in other circumstances at our discretion. On termination for breach, no refund will be issued for any remaining subscription period. We will endeavour to provide notice where legally and practically possible.

15. Changes to Terms

We may modify these Terms at any time. For material changes, we will provide at least 14 days' notice by email and/or prominent in-app notice before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you should delete your account before the effective date.

16. Governing Law & Disputes

These Terms are governed by the laws of England and Wales. Any disputes arising from or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory consumer protection law in your jurisdiction provides otherwise.
